District ‘C’ Magistrate’s Court matters for Tuesday, February 9, 2016

 

(CHARLESTOWN NEVIS)-The Magistrate Court in Charlestown, District C Nevis, resumed its normal sitting on Tuesday, February 9, 2016 before Her Honour Yasmine Clarke.

The first matter to commence was that of Leon Gumbs, a resident of Morning Star who was charged with grievous bodily harm. He pleaded guilty to the charge.

According to the Prosecution, the defendant got into an altercation with Leonora Jean-Jacques, and as a result struck her with a stone.

Her Honor noted that the matter was before the High Court, and the court had ordered the victim not to trespass on the property of the accused. However, the Magistrate told the accused, that in situations as such he ought not to take the law into his own hands. Her Honor continued, “You said that she came onto your premises and started throwing stones and you were throwing back some as well; but suppose you had killed her? It would have been a whole different story. When things like these happen you should either call the police or talk to your lawyer, but to take matters into your own hands is not the way to go about it”. The Magistrate told Gumbs not to appear before her again for something of any similar sort.

The Magistrate convicted and cautioned the defendant.

A few other matters were traversed to later dates.
