The Royal St. Christopher and Nevis Police Force (RSCNPF) Issues the Following Advisory Ahead of the Christmas and Carnival Season:

In light of recent incidents of public indecency — including events at the Basseterre Ferry Terminal — the public is reminded that such behaviour is not only inappropriate, but also illegal. The law is explicit, and enforcement will be strict.

Under the Small Charges Act (2017), CAP 4.36, the following offences apply:

Incorrigible Rogues – Section 30
Any person previously convicted as a rogue or vagabond who again commits a related offence may be deemed an “incorrigible rogue” and is liable to imprisonment for up to six months.

Indecent Behaviour – Section 31(1)
Any person who behaves indecently in a public place may be liable to imprisonment for up to one month.

Indecent Exhibition – Section 31(3)
Any person who willfully:
(a) exposes in a public place any obscene print, picture, photograph, or other indecent exhibition; or (b) exposes in any public place his or her person in an indecent manner; shall be deemed a rogue and vagabond and is liable to imprisonment for up to three months.

These are arrestable and jailable offences. There are no exemptions or excuses, even during festivities, celebrations or entertainment events.

As the Federation enters the Christmas and Carnival season, the RSCNPF reaffirms its operational stance: “Zero Tolerance. Zero Excuses.” Any acts of indecency, lewd exposure, disorderly conduct or behaviour in violation of the Small Charges Act (2017) or any other laws will prompt immediate police intervention.

The public is therefore urged to conduct themselves appropriately at all times — whether in entertainment venues, on the streets, or at Carnival events.

Guidance for Event Promoters, Organisers & Venue Managers

With the Christmas and Sugar Mas seasons upon us, the RSCNPF places direct responsibility on all event planners, promoters, and venue managers to ensure compliance with the law at all events. You are expected to:

Ensure that no performer, attendee, or participant engages in behaviour that violates any law.

Monitor event premises to prevent the facilitation, tolerance, or propagation of indecent acts.

Work with onsite security and law enforcement to remove or report offenders swiftly.

Understand that failure to maintain order may result not only in the shutdown of the event and legal action, but also in jeopardising future applications for event permissions.

The laws of the Federation are not suspended during the festive season. Events are not free zones for criminal activity or indecent conduct — and organisers will be held accountable for environments that facilitate such behaviour. The RSCNPF remains committed to ensuring a safe, respectful, and lawful festive season for all.
