The Royal St. Christopher and Nevis Police Force (RSCNPF) reminds the public that gang involvement is a serious criminal offence under the laws of Saint Kitts and Nevis. Recent amendments have significantly increased the penalties.
The Gang (Prohibition and Prevention) (Amendment) Act, 2025, strengthens existing legislation and introduces harsher consequences for those who participate in, support, or facilitate gang activity. Under the law, the formation of a gang, membership in a gang, or even attempting to become a member is illegal.
Persons convicted of these offences now face penalties of up to thirty (30) years’ imprisonment, while gang leaders and those directing gang activity may face up to forty (40) years’ imprisonment.
The Act criminalises a wide range of conduct connected to gangs. This includes recruiting others into gangs; encouraging or coercing persons to join; preventing individuals from leaving; and participating in any criminal activity associated with a gang. Assisting a gang, harbouring or concealing gang members, or possessing firearms, ammunition, or other items for the benefit of a gang are also serious offences carrying lengthy prison sentences.
The amended law introduces the offence of retaliatory action, which targets acts of violence, intimidation, or harassment against persons who refuse to join a gang, leave a gang, or assist law enforcement. A conviction for retaliatory action can result in imprisonment for up to forty (40) years.
Additionally, impersonating a law enforcement officer to further gang activity is now punishable by up to thirty (30) years’ imprisonment.
The law further provides for fines of up to one hundred thousand dollars (XCD $100,000), imprisonment of up to thirty (30) years for general offences, and the forfeiture of property connected to gang-related activity. These measures are intended to remove the financial benefits of crime and strengthen enforcement.
The RSCNPF urges all persons to avoid any association with gangs. The consequences are severe and long-lasting. Citizens are encouraged to report gang activity and work with law enforcement to keep communities safe.
